In this edition we asked about internet spam. Does the EU have any anti-spam legislation?

“Yes there is. There is a European Directive on Privacy and Electronic communication which applies to the sending of spam emails”, says the head of communications for the Belgian Commission for the Protection of Privacy, Eva Wiertz.

“Article 13 of this Directive states that spams or emails for the purposes of direct marketing must not be sent without the prior consent of the recipient. Moreover the identity of the person sending the email must not be concealed and an address must always be indicated.

This is that the recipient can write to the person sending the email to tell them to stop sending further messages, if they so choose.”
