EU tobacco advert ban looks likely to be upheld

Certain tobacco advertising and sponsorship banned under European Union rules will stay banned in spite of protests from Germany, if the European Court of Justice adopts the opinion rendered by its advocate general – which is what usually happens.

The advocate general proposes the EU’s top court dismiss the action brought by Germany against the EU’s tobacco advertising directive. The ban extends to all advertising in the printed media, and television and radio stations and the internet, harmonising national rules.

Germany had argued that the ban’s goal of establishing the 25 member single market was missed because almost all the media covered in the ban were only ever read locally or had a local audience and so should not come under EU rules.
